Homes and farms, nothing else
This page is part of our Ohio dispensary guide, and since March 20, 2026 the rule is short. You can smoke or vape cannabis only on privately owned property used mainly as a home or a farm. Before that, Ohio treated it like tobacco and banned it only in enclosed public places. Senate Bill 56 flipped that around.
Vaping counts as smoking. Lighting up anywhere else is a minor misdemeanor with a fine up to $150, and the same goes for a workplace, a child-care home or a halfway house.
Can I smoke here?
Tap a spot. Green means go, gold means it depends on someone else's rules, red means the law says no.
YesYour house or yard
Yes. A privately owned home is exactly where the law allows it, porch and backyard included.
YesA friend's place or farm
Yes, with the owner's okay. Farmland counts the same as a home under the law.
DependsApartment or rental
Read the lease. Landlords can ban smoking, vaping and home grow, common areas included. Breaking that clause is a lease problem, not a crime.
DependsHotel or Airbnb
Expect a no. The law allows homes and farms and never names hotels, and a hotel isn't a home. Ask before you light up.
NoSidewalk or street
No. Smoking or vaping it anywhere but a private home or farm is a minor misdemeanor, a fine up to $150.
NoCity and state parks
No. Parks fall outside the private property rule, and Cincinnati's park rules ban burning any plant where posted.
NoIn the car
No. A driver who smokes falls under the impaired driving law, and a passenger who lights up while the car moves faces up to 60 days and $500.
NoBar, restaurant or patio
No. Smoking or vaping it is banned in any public place or workplace, and businesses don't have to allow it.
NoA consumption lounge
No. Ohio licenses growers, processors, dispensaries and labs, and no lounges, so there's nowhere to smoke on site.
NoAt work
No. Workplaces are off limits, and employers can still test for it, refuse to hire, or fire over it.
DependsA gummy on a walk
Gray area. The public use ban is written around enclosed public places, and we haven't found guidance on an edible outdoors. Don't count on it.
NoState park campsite
No. A campsite isn't a private home, and state park rules ban smoking where it's prohibited.
NoA child-care home
No. The law bans smoking or vaping it at a child-care home, even though it's a private house.
NoCuyahoga Valley
No. National parks and forests are federal land, where Ohio's law gives no cover to use or even carry it.
